By accessing our website, purchasing any service, or engaging with our coaching programs, you agree to be bound by these Terms. If you do not agree, you must not use our website or services.

1. About Us and This Agreement

The Lifestyle Club Pty Ltd (TLC24 Coaching) ("we," "us," "our") is an Australian fitness, nutrition, and lifestyle coaching and education business. We operate via our website at , and deliver services online, in person, through online courses and programs, and via our client portal and mobile application.

These Terms and Conditions (“Terms”) govern:

       Your access to and use of our website;

       Your purchase of and participation in our coaching services, meal plans, fitness programs, online courses, and group coaching communities; and

       Your use of our client portal, mobile application, and any associated platforms.

These Terms are to be read together with our Privacy Policy, which is incorporated by reference and available on our website.

2. Acceptance of Terms

By doing any of the following, you confirm that you have read, understood, and agree to be bound by these Terms:

       Accessing or browsing our website;

       Creating an account on our website, client portal, or mobile application;

       Purchasing any service, program, course, or membership;

       Submitting a client intake form or health questionnaire; or

       Participating in any coaching session, group program, or community.

If you are agreeing to these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

 

You must be at least 18 years of age to use our website and purchase our services. By accessing our website or purchasing services, you represent and warrant that you are 18 years of age or older. We do not knowingly provide services to persons under 18 without verified parental or guardian consent.

 

3. Our Services

3.1 Description of Services

The Lifestyle Club Pty Ltd (TLC24 Coaching) provides the following services (collectively, "Services"):"

       Online and remote one-on-one fitness and nutrition coaching;

       In-person coaching sessions (where available);

       Personalised meal plans and nutrition programming;

       Personalised fitness and exercise programming;

       Lifestyle coaching and education, including sleep, stress management, and habit formation;

       General supplement education and recommendations;

       Online courses and self-paced educational programs;

       Group coaching programs and community memberships;

       Access to a client portal and/or mobile application for program delivery and communication.

 

3.2 Not Medical or Clinical Services

IMPORTANT HEALTH DISCLAIMER: The Services provided by The Lifestyle Club Pty Ltd (TLC24 Coaching) are general fitness, nutrition, and lifestyle coaching services. They do not constitute medical advice, clinical nutrition advice, physiotherapy, psychology, or any other regulated health service. We are not registered medical practitioners, clinical dietitians (unless separately credentialled), physiotherapists, or psychologists.

 

In particular:

       Our meal plans and nutrition guidance are general in nature and do not replace the advice of an Accredited Practising Dietitian (APD) or medical professional.

       Our fitness programming is general coaching and does not replace assessment or treatment by a physiotherapist, exercise physiologist, or medical professional.

       Our supplement recommendations are general educational information only. We recommend all clients consult their GP or pharmacist before commencing any supplement protocol.

       If you have a pre-existing medical condition, injury, or health concern, you must obtain clearance from a qualified medical professional before commencing our programs. We reserve the right to require written medical clearance before accepting a client.

       If at any time during our Services you experience a medical emergency, please immediately contact emergency services on 000.

 

3.3 Service Modifications

The Lifestyle Club Pty Ltd (TLC24 Coaching) reserves the right to modify, suspend, or discontinue any Service, course, or program at any time. Where a material change affects a service you have paid for and not yet received, we will provide reasonable notice and, where applicable, a pro-rata refund or suitable alternative.

 

4. Your Responsibilities as a Client

To enable us to provide safe and effective Services, you agree to:

       Provide accurate, complete, and up-to-date information in all intake forms, health questionnaires, and communications with your coach;

       Disclose all relevant medical conditions, injuries, medications, and health concerns before commencing any program;

       Promptly notify us of any changes to your health status, medications, or circumstances that may affect your program;

       Follow the programs provided only to the extent that they are safe and appropriate for your current condition;

       Seek independent medical advice if you are unsure whether any aspect of your program is suitable for you;

       Engage with your coach honestly and communicate any difficulties, discomfort, or concerns about your program;

       Respect the intellectual property, confidentiality, and community guidelines applicable to any group program or community you participate in;

       Pay all fees in accordance with the payment terms set out in these Terms; and

       Comply with all applicable laws when using our website, client portal, or mobile application.

 

5. Pricing, Payment, and Subscriptions

5.1 Fees and Pricing

All fees for our Services are set out on our website at or as otherwise agreed in writing. All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable, unless otherwise stated.

The Lifestyle Club Pty Ltd (TLC24 Coaching) reserves the right to change pricing at any time. For existing subscription clients, price changes will be communicated with at least 14 days' written notice before taking effect.

 

5.2 One-Off Program Purchases

When you purchase a one-off program, course, or package:

       Payment is due in full at the time of purchase, unless a payment plan has been expressly agreed in writing;

       Access to the program or course materials will be granted upon receipt of cleared payment;

       Payment plans, where offered, are subject to the full amount being paid regardless of whether you complete the program.

 

5.3 Recurring Subscriptions and Memberships

Where you purchase a recurring subscription or membership:

       Your subscription will automatically renew at the end of each billing period (weekly, fortnightly, or monthly as specified) unless cancelled in accordance with clause 5.6;

       Payment will be charged to your nominated payment method on the renewal date;

       You authorise us (or our payment processor) to charge your nominated payment method for all applicable subscription fees on a recurring basis;

       If a payment fails, we will attempt to contact you and may suspend access to Services until payment is received. Repeated failed payments may result in termination of your subscription;

       Subscription fees are non-refundable for the current billing period, except as required by the Australian Consumer Law (ACL).

 

5.4 Group Coaching and Community Memberships

Group coaching programs and community memberships are subject to the following additional terms:

       Access is granted for the specified program duration or membership period;

       Group programs may have fixed intake dates, and late entry into a program may not be available;

       Community membership fees are billed on a recurring basis and may be cancelled at any time, with access continuing until the end of the current billing period.

 

5.5 Payment Processing

Payments are processed by secure third-party payment processors. The Lifestyle Club Pty Ltd (TLC24 Coaching) does not store your full payment card details. By providing your payment details, you authorise us to charge your nominated method for all fees payable under these Terms. You are responsible for ensuring your payment details are current and accurate.

 

5.6 Cancellation of Subscriptions

You may cancel your subscription at any time by:

       Logging into your account on our client portal and cancelling via your account settings; or

Cancellation will take effect at the end of your current billing period. You will retain access to Services until that date. No partial refunds are provided for unused time within a billing period, except as required by the ACL.

 

5.7 GST

All fees are inclusive of Goods and Services Tax (GST) where applicable under the A New Tax System (Goods and Services Tax) Act 1999 (Cth). A tax invoice will be issued upon request.

 

6. Refunds and Australian Consumer Law

Nothing in these Terms limits, excludes, or modifies any rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other non-excludable statutory right. The rights described below are in addition to, and do not limit, your ACL rights.

 

6.1 Your Rights Under the Australian Consumer Law

Under the ACL, our Services come with consumer guarantees that cannot be excluded. If a Service fails to meet a consumer guarantee, you are entitled to a remedy. Depending on the nature of the failure, this may include a refund, re-supply of the service, or compensation.

 

6.2 Our Refund Policy

Subject to your ACL rights, our refund policy is as follows:

       One-off program and course purchases: No refund is provided once you have accessed the program or course materials, except where required by the ACL.

       Recurring subscriptions: Fees paid for the current billing period are non-refundable upon cancellation, except where required by the ACL.

       In-person sessions: Cancellations made with less than 24 hours' notice may forfeit the session fee. Cancellations made with more than 24 hours' notice will be rescheduled at no charge.

       Group programs: Where a group program cannot be delivered due to our actions, a pro-rata refund or alternative will be provided.

 

6.3 Requesting a Refund

To request a refund, contact us at [email protected] with your name, order details, and the reason for your request. We will assess all refund requests within 10 business days.

 

7. Intellectual Property

7.1 Our Content

All content on our website, client portal, mobile application, online courses, and coaching programs — including but not limited to meal plans, fitness programs, educational materials, videos, graphics, written content, templates, and the The Lifestyle Club Pty Ltd (TLC24 Coaching) brand — is owned by or licensed to The Lifestyle Club Pty Ltd (TLC24 Coaching) and is protected by Australian copyright law (Copyright Act 1968 (Cth)), trade mark law, and other applicable intellectual property laws.

 

7.2 Permitted Use

We grant you a limited, non-exclusive, non-transferable, personal licence to access and use the content provided to you as part of your purchased Services, for your own personal, non-commercial use only.

 

7.3 Prohibited Use

You must not, without our prior written consent:

       Copy, reproduce, distribute, republish, sell, or commercially exploit any of our content;

       Share, on-sell, or provide access to program materials, meal plans, or course content to any third party;

       Modify, adapt, translate, or create derivative works from our content;

       Remove any copyright, trade mark, or proprietary notices from our materials; or

       Use our brand, logos, or trade marks without our express written consent.

Breach of this clause may result in immediate termination of your access and may give rise to legal action.

 

7.4 Your Content

Where you submit content to us (such as progress photos, food diary entries, or feedback), you grant us a non-exclusive, royalty-free licence to use that content solely for the purpose of delivering your Services. We will not use your personal content for marketing purposes without your separate, express written consent.

 

8. Website Use

8.1 Acceptable Use

You may use our website for lawful purposes only. You agree not to:

       Use our website in any way that breaches any applicable Australian or international law or regulation;

       Use our website in any fraudulent or harmful manner, or for any purpose that is deceptive or misleading;

       Transmit any unsolicited or unauthorised advertising or promotional material;

       Upload or transmit any viruses, malware, or other harmful code;

       Attempt to gain unauthorised access to any part of our website, server, or systems;

       Harvest or collect any data or personal information from our website without our consent;

       Interfere with or disrupt the operation of our website or servers; or

       Use automated tools (bots, scrapers, crawlers) to access or extract data from our website without our express written permission.

 

8.2 Client Portal and Mobile Application

Your access to our client portal and mobile application is subject to these Terms and any additional terms of use published within those platforms. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorised use of your account.

 

8.3 Third-Party Links

9. Communications and SMS / Electronic Messaging

9.1 Service Communications

By engaging our Services, you agree to receive service-related communications from us, including appointment reminders, check-in prompts, program updates, billing notices, and account information. These communications are necessary for the delivery of our Services and are not subject to opt-out (though you may update your contact preferences).

 

9.2 SMS / MMS Messaging

If you provide your mobile number and opt in to SMS communications, you agree to receive SMS or MMS messages from us, which may include:

       Appointment and session reminders;

       Program check-in prompts;

       Account and service updates; and

       Promotional or educational messages (where you have separately consented).

Consent to receive SMS messages is not a condition of purchasing our Services. Standard message and data rates may apply depending on your mobile carrier. We are not responsible for delays or delivery failures caused by your carrier.

 

9.3 Opt-Out

9.4 Electronic Marketing (Spam Act 2003)

10. Group Coaching and Community Guidelines

Where you participate in a group coaching program or online community operated by The Lifestyle Club Pty Ltd (TLC24 Coaching), you agree to the following Community Standards:

       Treat all community members, coaches, and staff with respect and professionalism;

       Do not share, reproduce, or distribute any content from the community (including other members' personal information, progress updates, or program materials) outside the community without consent;

       Do not engage in harassment, bullying, discrimination, or any conduct that is offensive, threatening, or harmful to other members;

       Do not post spam, promotional content, or unsolicited commercial messages within community spaces;

       Do not provide medical, clinical nutrition, or other regulated professional advice to other members;

       Respect the intellectual property of The Lifestyle Club Pty Ltd (TLC24 Coaching) and other community members; and

       Comply with any additional community guidelines published within the group platform.

The Lifestyle Club Pty Ltd (TLC24 Coaching) reserves the right to remove any content from community spaces and to terminate a member's access to a community program without refund in the event of a serious or repeated breach of these Community Standards.

 

11. Limitation of Liability

11.1 General Limitation

To the maximum extent permitted by law (including the Australian Consumer Law), and except in relation to non-excludable statutory guarantees:

       The Lifestyle Club Pty Ltd (TLC24 Coaching)'s total aggregate liability to you for any claim arising out of or in connection with these Terms or the Services is limited to the total fees paid by you to The Lifestyle Club Pty Ltd (TLC24 Coaching) in the three (3) months preceding the event giving rise to the claim;

       The Lifestyle Club Pty Ltd (TLC24 Coaching) is not liable for any indirect, incidental, special, consequential, or punitive loss or damage (including loss of profits, loss of data, or loss of opportunity) arising out of or in connection with the Services or these Terms, even if advised of the possibility of such loss; and

       The Lifestyle Club Pty Ltd (TLC24 Coaching) is not liable for any loss or damage arising from your failure to follow program instructions, failure to disclose relevant health information, or failure to seek appropriate medical advice.

 

11.2 Health and Injury Disclaimer

Participation in fitness and nutrition programs carries inherent risks, including the risk of physical injury. By participating in our Services, you:

       Acknowledge that you participate voluntarily and at your own risk;

       Confirm that you have disclosed all relevant health conditions and that you are medically fit to participate (or have obtained appropriate medical clearance);

       Release and indemnify The Lifestyle Club Pty Ltd (TLC24 Coaching), its officers, employees, contractors, and agents from and against any claim, loss, damage, or liability arising from your participation in our Services, to the extent permitted by law; and

       Acknowledge that the above release does not apply to the extent that any loss or injury is caused by our negligence or breach of a non-excludable statutory guarantee.

 

11.3 Information Accuracy

The Lifestyle Club Pty Ltd (TLC24 Coaching) takes reasonable care to ensure that the information on our website and in our programs is accurate and up to date. However, we do not warrant the completeness or accuracy of any information, and you should not rely on website content as a substitute for professional advice tailored to your circumstances.

 

12. Indemnity

You agree to indemnify, defend, and hold harmless The Lifestyle Club Pty Ltd (TLC24 Coaching), its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

       Your breach of these Terms;

       Your violation of any applicable law or regulation;

       Your provision of false or misleading health information to us;

       Your use of the website, client portal, or mobile application in an unauthorised manner; or

       Your infringement of any third party's intellectual property or other rights.

 

13. Suspension and Termination

13.1 Termination by You

You may terminate your engagement with us at any time by cancelling your subscription or notifying us in writing. Termination is subject to the payment and refund provisions in clause 5 and 6 of these Terms.

 

13.2 Termination or Suspension by Us

The Lifestyle Club Pty Ltd (TLC24 Coaching) may suspend or terminate your access to Services and/or your account at any time, with or without notice, if:

       You breach any provision of these Terms and fail to remedy the breach within 7 days of being notified;

       You engage in conduct that is harmful, abusive, or threatening to our staff, contractors, or other clients;

       You provide false or materially misleading information in your intake forms or communications;

       We reasonably believe that your participation poses a risk to your health or safety or the health or safety of others;

       You fail to make payment as required; or

       We are required to do so by law.

Where we terminate your access for reasons other than your breach, we will provide a pro-rata refund for any unused prepaid Services, where applicable.

 

14. Privacy

Your privacy is important to us. Our collection, use, storage, and disclosure of your personal information (including sensitive health information) is governed by our Privacy Policy, which is available at and is incorporated into these Terms by reference.

By using our Services, you consent to the collection and use of your personal information in accordance with our Privacy Policy. Our Privacy Policy complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

 

15. Modifications to These Terms

The Lifestyle Club Pty Ltd (TLC24 Coaching) may update these Terms from time to time. Where we make material changes, we will:

       Publish the updated Terms on our website with a new effective date;

       Notify active clients via email at least 14 days before material changes take effect; and

       Where required, seek fresh consent for changes that materially affect your rights.

Your continued use of our Services after the effective date of updated Terms constitutes your acceptance of those updated Terms. If you do not agree with the updated Terms, you should stop using our Services and cancel any active subscription in accordance with clause 5.6.

 

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of Australia and the State of . You and The Lifestyle Club Pty Ltd (TLC24 Coaching) each submit to the non-exclusive jurisdiction of the courts of and Australian federal courts.

 

16.2 Dispute Resolution

We are committed to resolving disputes fairly and efficiently. If a dispute arises, the parties agree to follow this process before commencing legal proceedings:

       Step 1 — Notify us in writing of the nature of the dispute and the outcome you seek;

       Step 2 — We will respond within 10 business days with our position and a proposed resolution;

       Step 3 — If the dispute is not resolved within 30 days of notification, either party may refer the matter to mediation, or pursue other legal remedies available under Australian law.

This clause does not prevent either party from seeking urgent interlocutory or injunctive relief.

 

16.3 Australian Consumer Law

Nothing in these Terms limits your rights under the Australian Consumer Law or any other non-excludable right conferred by statute.

 

17. General Provisions

       Entire Agreement: These Terms, together with our Privacy Policy and any service agreement or program agreement entered into with you, constitute the entire agreement between you and The Lifestyle Club Pty Ltd (TLC24 Coaching) with respect to the Services.

       Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

       Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

       Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms at any time.

       Force Majeure: We are not liable for any failure or delay in performance of our Services caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemic, telecommunications failures, or government-imposed restrictions.

       Relationship: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and The Lifestyle Club Pty Ltd (TLC24 Coaching).
